These Terms of Use ("Terms") govern your use of OpenNovel (the "Service"), a platform that provides tools for translating webnovels. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to comply with and be bound by these Terms and all applicable laws and regulations.

2. Description of Service

OpenNovel offers a suite of tools designed to assist users in translating webnovels from various languages. Our platform facilitates the translation process but does not publish or claim ownership of any translated content.

3. Fair Use Policy

Fair Use Policy for Translation Plans

To ensure the best possible experience for all users, our "Unlimited Chapter Translations" are subject to a Fair Use Policy.

While we offer generous translation limits intended to cover the vast majority of use cases, extremely high-volume usage may trigger rate-limiting measures. This enables us to maintain service stability and quality for everyone.

The following are the thresholds for each plan per month:

• - Casual Plan: After 1,500,000 output tokens, users may experience slower translation speeds.
• - Hobby Plan: After 4,500,000 output tokens, users may experience slower translation speeds.
• - Bookworm Plan: After 9,000,000 output tokens, users may experience slower translation speeds.

Please note that unused tokens do not carry over to the next month.

We reserve the right to implement reasonable technical limitations to prevent service abuse and to ensure fair access for all users. We may also reduce the threshold during peak hours to keep OpenNovel accessible to the widest number of people.

Upgrade policy

When you upgrade your plan for the current month, you will only be charged for the remaining time in the month.

Automation is strictly prohibited

The use of automation tools, such as macros or scripts to access or interact with our platform is strictly prohibited. If use of automation is suspected or detected, we reserve the right to immediately ban the offending account from using our service.

Unauthorized Commercial Distribution is strictly prohibited

Using our tools to generate content for unauthorized commercial distribution, including but not limited to pirate sites or other platforms that distribute copyrighted content without proper authorization, results in an immediate and permanent ban from our service. This policy is strictly enforced to protect content creators and maintain the integrity of our platform.

4. User Responsibilities

• Eligibility: You must be at least 18 years old to use the Service.
• Account: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to immediately notify OpenNovel of any unauthorized use of your account or any other breach of security.
• Content Use: You agree to use the Service solely for personal and non-commercial purposes.
• Translation Responsibility: Users are solely responsible for ensuring they have the legal right to translate the content they use with our tools. By using the Service, you represent and warrant that you have the necessary rights and permissions to translate the content.
• Compliance with Laws: You agree to comply with all applicable local, state, national, and international laws and regulations in your use of the Service.

Infringement or Misuse: We do not represent or warrant that your access to and use of OpenNovel will not constitute an infringement or misuse of the rights and interests of any other person, including Intellectual Property Rights belonging to such person.

5. Content Ownership and Licenses

• Third-Party Content: The original webnovels are the intellectual property of their respective authors and publishers. OpenNovel does not claim ownership of the original content or any translations created using our tools.
• User Translations: Any translations created using the Service are the responsibility of the individual users. OpenNovel does not store, publish or assume any liability for these translations.

6. Limitation of Liability

Disclaimer of Warranties: The Service is provided "as is" and "as available." OpenNovel makes no representations or warranties of any kind, express or implied, regarding the Service or the content, including, without limitation, any warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, timely, secure, or error-free.

Limitation of Liability: To the maximum extent permitted by law, OpenNovel shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service, even if OpenNovel has been advised of the possibility of such damages. In no event shall OpenNovel's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Service.

7. Indemnification

You agree to indemnify, defend, and hold harmless OpenNovel and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

8. Termination

OpenNovel reserves the right to suspend or terminate your account and access to the Service at any time, without notice, for conduct that we believe violates these Terms, is harmful to other users of the Service, us, or third parties, or for any other reason.

9. Changes to the Terms

OpenNovel reserves the right to modify these Terms at any time. We will provide notice of such changes by posting the updated Terms on our website. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.

10. Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any legal actions, suits, or proceedings arising out of or relating to these Terms shall be brought exclusively in the courts located in Singapore.

DMCA Notice and Takedown Policy

OpenNovel respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA") and other applicable law, OpenNovel has adopted a policy of responding to proper notifications of alleged copyright infringement and taking appropriate actions, including removing or disabling access to material hosted on our platform that is claimed to be infringing.

If you believe that your copyrighted work has been copied, translated, or otherwise used in a way that constitutes copyright infringement, please submit a written notice to our designated agent at support@opennovel.co with the following information:

• - A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed;
• - Identification of the copyrighted work claimed to have been infringed;
• - Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material;
• - Your contact information, including your name, address, telephone number, and email address;
• - A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
• - A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Upon receipt of a valid DMCA notice, OpenNovel will respond expeditiously by removing or disabling access to the allegedly infringing material hosted directly on our platform.

Please note: OpenNovel provides tools that enable users to translate content from external websites and user-submitted text. OpenNovel does not host or control third-party websites or their content. If the allegedly infringing material is hosted externally (i.e., not on OpenNovel's servers), we may not be able to remove or disable access to it. In such cases, contact the third-party website or content owner directly.
